Terms and conditions of Sale please read this webpage fully and carefully:

By checking the box on the order confirmation page during checkout, or ordering any item by phone, you are agreeing to accept these terms and conditions as a legal binding contract. 

When purchasing any vehicle on this site to be shipped unassembled in a steel crate, you the consumer assume, in its entirety, the responsibility off the dealer. Any defects normally corrected, and rarely seen by the end user during the PDI (pre delivery inspection) process are your responsibility and will need to be addressed as needed by you the consumer. All nuts, bolts, fasteners, castle nuts, cotter pins, Etc, must be checked and verified for tightness. Any discrepancies in workman ship, including missing parts, shipping damage, or manufacture defects will be addressed Via. the warranty procedure as required. Most dealers charge up to $400 to assembly and prep these units but you can take advantage of the cost savings while buying factory direct.


Cancelations:

(Once Shipped) All sales are final. Returns or cancelations at this point must be handled thru our standard return policy agreement procedure.

If the unit or units Have Not Yet Shipped (Most items ship within 12hrs) and the customer requests a refund for any reason outside our control, a reversal can be made but there will be a 4% credit card reversal fee. This is due to the fee that the credit card company charges us to refund your money. This fee does not apply to out of stock or otherwise unshippable purchases due to delivery location or specific model / color unavailability. In these cases refunds of 100% are given.


Refusal of Shipment:

Any customer who denies or refuses a delivery, or makes no provisions for the trucking company to schedule a delivery, will be charged any and all shipping fees associated with the return / reshipment of the vehicle back to the factory and if applicable, again back to the customer. If customer is not contacted by the trucking company within 7 days of purchase, it is the customers responsibility to notify us immediately, and verify delivery schedule. The trucking company may for whatever reason not be able to get in touch with you. If a valid attempt is not made to receive vehicle once shipped and vehicle is returned to factory, all fees incurred with return of vehicle back to the factory, will be deducted, along with a 20% restocking fee from any moneys returned to customer.


Returns / Refunds:

We value your complete satisfaction. If within 5 days of receiving your vehicle you decide you do not want your item for any reason, we may refund your money or send you a replacement item based on our return policy agreement. 

 


Return Policy Agreement for Motorized Vehicles:

  • Customers are responsible for returning any motorized vehicle at their own expense. Freight collect and COD packages will not be accepted.

  • Customers must get prior authorization from Familyfunpowersports before return shipping. Any items returned without prior authorization will not be accepted.

  • Vehicle must be returned in its original packaging within 5 days, in new and re-sellable condition.

  • All packaging materials, instruction manuals and parts must be returned with the unit. Any missing parts or damages will be deducted from your refund amount. We do not accept any return vehicle that has any sustained damages.

  • This return policy does not apply to vehicles that have had alterations, abuse, negligence, have been in an accident or have not received proper maintenance.

  • This return policy does not apply to vehicles that been used and fueled, If the vehicle has been used and fueled you may only return your vehicle for repairs.

  • If you have received your vehicle for more than 5 days With or without using or fueling, you will not be eligible to return it for refund or replacement.

  • If warranty work or repairs are needed, You can send the vehicle or parts to us at your own expense; we will repair it and send it back to you also at your expense.

  • In order to keep you completely satisfied and maintain rock bottom prices, our shipping expenses are neither refundable nor reimbursed for any reason. This includes all freight charges: The first included (Free shipping) cost, and the return back to the factory shipping cost. Original freight expense will be deducted from your refund.

  • Order may be canceled only if we are unable to fulfill and ship your order within 10 business days. However you will be charged a 4% cancelation fee if canceled for any other reason then stated above.


Return Policy Agreement for Parts:

  •  Customers are responsible for returning the merchandise at their own expense. Freight collect and COD packages will not be accepted.

  • Customers must get prior authorization from Familyfunpowersports before return shipping. Any items returned without prior authorization will not be accepted.

  • Parts must be returned in its original packaging within 14 days of delivery, in new and re-sellable condition.

  • This return policy does not apply to parts that have had alterations, abuse, negligence, have been used or installed on any vehicle or are older than 14 days.

  • All packaging materials, instruction manuals must be returned with the parts. Any missing parts or damages will be deducted from your refund amount.

  • If the part or parts has been used a return will not be accepted.

  • If warranty work or repairs are needed, You can send the vehicle or parts to us at your own expense; we will repair it and send it back to you also at your expense.

  • In order to keep you completely satisfied and maintain rock bottom prices, our shipping expenses are neither refundable nor reimbursed for any reason. This includes all freight charges: The first included cost, and the return back to the factory shipping cost. Original freight expense will be deducted from your refund.

  • Due to health and personal hygiene concerns, all clothing and helmets are non-refundable.

  • Order may be canceled only if we are unable to fulfill and ship your order within 10 business days. However you will be charged a 4% cancelation fee if canceled for any other reason then stated above.

  • There are no returns on Brake parts, Carburetors, Batterys, or any eletric cdi part CDI coils staters ext.. all sales are final no returns 


Warranty Claims / What's Covered:

Here at Familyfunpowersports we warrant every product we sell to be free from manufacturer’s defects in materials and workmanship. In other words, the new vehicle should perform as intended when delivered to the purchaser. This limited warranty is for defects from the manufacturer only.

Off-Road Vehicles: Including all ATVs, Go Kart's, UTV's, and Dirt Bike's (Non SSR): 

The Limited Warranty on your new vehicle begins the day you take delivery. Familyfunpowersports will supply (to you the customer) any parts deemed defective, for installation (by you the customer) Free of Charge (Shipping rates will apply) for the time period specified in the chart below. After expiration of the Limited Warranty, any and all repairs are the responsibility of the owner. Familyfunpowersports provides a ninety (90) day Limited Warranty for all other parts, except as noted, from the Start Date. 

Engine Warranty: If an engine is deemed defective, you the customer are required to send the engine to us for repair. After receiving the engine Familyfunpowersports will diagnose, and at our discretion, install new or rebuilt parts in exchange for defective parts, at no charge for a period of one (1) year from the Limited Warranty Start Date.

Note: Familyfunpowersports does not cover any shippings costs (to or from the customer) for warranty issues.

Definitions:

Engine (Lubricated Parts):
All internal lubricated parts, i.e. pistons, piston rings, piston wrist pins, connecting rods, rod bearings, camshaft, camshaft bearings, timing chain, crankshaft, crankshaft main bearings, oil pump, water pump (where applicable), valves, valve springs, valve guides, valve seats, valve lifters and valve push rods. The engine cylinder head and cylinder will only be covered if damage is caused solely as a result of the mechanical failure of one or more internal lubricated components listed above.

Transmission System (Automatic or Standard):
All internal lubricated parts contained within the transmission case, i.e. flywheel, hydraulic shift linkage, kick start spindle, kick start secondary gear and transmission gears. The transmission case itself will be covered if any damage was caused solely as a result of mechanical failure of one or more of the internal lubricated components contained within the transmission case.

Drive System:
All internal lubricated parts contained within the drive axle housing case (where applicable), i.e. differential, differential gears, driveshaft, drive axles, CV joints, axle bearings, reverse gears and output shafts. The drive axle housing as well as the reverse gearbox housing will be covered, only if damaged solely as a result of the mechanical failure of one or more or the internal lubricated components contained the drive axle housing,

Fuel System:
Carbureted vehicles: the carburetor, vacuum fuel pump, intake manifold, fuel tank and fuel petcock.

Electrical System:
Stator, stator pickup, magneto, voltage regulator/ rectifier, CDI, starter relay/starter solenoid and starter motor (where applicable), coil, distributor assembly and injector relay (if/when applicable).

Cooling System (liquid-cooled vehicles only):
Radiator, radiator cap, thermostat, thermostat housing, temperature indicator sensor or switch, cooling fan motor(s), water pump and water pump housing.

Brakes System:
Calipers, brake drum housings, drum brake linkage, reservoirs, rotors, and lines. Brake pad and/or linings are not covered

Chassis:
Frame, swing arms, A-arms, steering controls (linkages, rod ends, steering boxes and/or racks.)

Suspension System:
Forks and Shocks components

Intake & Exhaust System
Air Filter Box, Intake manifold, Exhaust Pipe, Muffler

Engine Case:
The engine case itself will only be covered if damage caused was solely as a result of the mechanical failure of one or more of the internal lubricated components listed above.

For all warranty claims a form will be emailed to the customer for them to complete and return before we can submit a claim.  

Familyfunpowersports LLC is bound by the decisions of the manufacturer for warranty and replacement parts issues and at no time can be held responsible for their actions or decisions.

All of our ATV’s, Dirt Bikes, Scooters, Go-Karts, and Pit Bikes (Except SSR Motorsports) are covered by the manufacturer (TaoTao, Cougar Cycle, Kandi, SSR, TrailMaster, etc) for a period of 90 days on defective Parts and 1 year on defective engines (SSR Engines are covered for 30 days only) All beginning the date of purchase. All warranty claims are handled directly with the manufacturer through Familyfunpowersports LLC.

This standard Parts warranty disclosure covers the replacement of (Non wearable) parts only, Labor charges to replace parts and shipping fees to ship parts is not covered under warranty and is the sole responsibility of the consumer. This includes the shipping of parts to repair a vehicle damaged during shipping, parts to repair factory defects found during assembly, and parts found to be defective during and after initial break-in. Labor charges to diagnose, repair, replace, or install defective parts is also not covered under warranty and is the responsibility of the consumers.

Please make sure you fully read and understand all descriptions, recommendations, and sizing dimensions before your purchase. At no time (after 5 days) can any ATV, Scooter, Go-Kart, Dirt Bike, or Pit Bike be returned for a refund or exchange for any reason once the item has been shipped. Motor vehicles arriving damaged will be handled using the above mentioned parts warranty disclosure. At no time can a vehicle be returned to Familyfunpowersports LLC or its affiliates (TaoTao, Cougar Cycle, Kandi, SSR, TrailMaster, etc) Where a part or parts can be replaced (by an averagely skilled mechanical person) that would bring the vehicle back to acceptable appearance and functionality.

Be sure to fully inspect your unit prior to signing the release form from the trucking company. If damage is noted document damage with shipper and call us immediately for further instruction. (Do not return ATV, Go Kart, Dirt Bike, Scooter or Pit Bike to sender without prior authorization from Familyfunpowersports). If returned without prior approval buyer will assume all shipping costs associated with return and reshipment of new ATV plus a 20% restocking fee. All Deliveries must have a confirmed delivery date and signature between customer and shipping company.


Model year Specifics:

While we do our very best to insure model years are listed correctly sometimes the factory will ship model years as old as 2009. Most units are current year models but the factory has been known to ship older models if available keep stock rotating, or as stated by the manufacturer misprint MSO paperwork with older model years. In these cases Familyfunpowersports will not return or refund any vehicle due to model year discrepancy as all units sold (as-new) regardless of model year meet all description and performance standards as described.


Shipping Policy:

Shipping is free to most states in the continental US on all ATVs, Scooters, Go-karts, and Dirt Bikes (Standard shipping rates will apply to all other merchandise) Items will usually arrive in about 5-7 business days. Although we do everything in our power to maintain free shipping for all our customers some states unfortunately may require an additional fee usually between $70 and $100 dollars. These states include but are not limited to, Maine, Montana, Washington, Most areas of New York, and some areas of Arizona. We cover shipping costs up to $120 on Mid size ATV's and $180 on full size ATV's. If after receiving your order we determine your shipping location requires an additional shipping fee we may contact you for the additional charges. Lift gate service to your door is always free (accept on SSR PitBikes) Most company's usually charge additional for this we include it free. Our pricing on SSR products is rock bottom and we are not able to include lift gate service with these units. They are relatively light compared to a ATV or Go Kart and with the help of friend fairly easy to lift of a standard freight truck. If lift gate is needed a $35 fee will be added. We have shipping locations scattered throughout the US. Be sure to fully inspect your unit prior to signing the release form from the trucking company. If damage is noted document damage with shipper and call us immediately for further instruction. (Do not return ATV to sender without prior authorization from Family Fun Powersports). If returned without prior approval buyer will assume all shipping costs associated with return and reshipment of new ATV. Local pick up is available in Skillman NJ 08558. SSR Motorsports Specific Warranty:

Warranty starts from date of purchase by the consumer from their SSR MOTORSPORTS dealer for all SSR MOTORSPORTS products. During the warranty policy period, SSR MOTORSPORTS will only cover all warranty parts. The dealer is required to order parts for all warranty work to be performed.

​VEHICLE OWNER'S RESPONSIBILITY

  • It is the responsibly of the owner to maintain and care for the vehicle as outlined in the owners manual. Owners must service and maintain the vehicle in accordance with the owners manual. All service and maintenance should be performed by an authorized SSR dealer or any reputable cycle repair shop. Period maintenance  and inspections are considered REGULAR maintenance and are not subject to warranty or reimbursement.

SSR MOTORSPORTS DOES NOT COVER THE LABOR OR SHIPPING REQUIRED TO REMOVE OR SHIP THE VEHICLE OR PART FOR WARRANTY REPLACEMENT.

DAMAGED CAUSED BY THE FOLLOWING IS NOT COVERED UNDER WARRANTY:

Unavoidable natural disasters, fire, collision, theft, improper storage or transportation, negligence of the periodic maintenance, improper use or repair or adjustment or maintenance, using product as a rental vehicle or commercial use, unauthorized modification made to the product, keeping riding when the vehicle is overheating, installing performance parts or components on the vehicle that changes the original engineering. 

IF YOU NEED WARRANTY REPAIRS:

All warranty repairs must be processed and performed by the selling dealer. ALWAYS CONTACT THE SELLING DEALER FIRST! Only if you cannot reach your dealer should you contact SSR Motorsports for warranty issues or repairs, and if you do you must provide a copy of the original invoice showing our model number, vehicle identification number (VIN) and date of purchase, before we can warrant your product directly. SSR MOTORSPORTS DOES NOT COVER THE LABOR OR SHIPPING REQUIRED TO REMOVE OR SHIP THE VEHICLE OR PART FOR WARRANTY REPLACEMENT.

VEHICLE INSPECTION:

SSR Motorsports vehicles are carefully inspected at the assembly plant and, with the exception of “drop shipped” vehicles, at the dealership prior to retail delivery. Occasionally something may slip past us, and a customer may find that a vehicle was damaged before he or she took delivery. If you see any damage when you receive you vehicle, notify your dealer immediately or as soon as you possibly can.

LABOR/SHIPPING CHARGES:

SSR Motorsports does not pay for labor to repair or replace component(s) or part(s) subject to wear and tear (see: Parts Not Covered by Limited Warranty), or component(s) or part(s) sustaining damage from abuse, accident(s), and/or shipping under the terms of the Limited Warranty. The Limited Warranty does not cover any damages caused by or resulting from shipping, misuse, abuse, or other reason except for a manufacturer's defect.

All warranted parts must first be sent to SSR Motorsports for inspection and verification of defect(s). Until the parts are sent to us, replacement parts will not be sent under the terms of the Limited Warranty. Failure to do so may result in you getting the wrong part. We are not responsible for wrong parts sent if we do not have your part to exchange and verify correct part numbers.

In some cases, the parts may have to be shipped from overseas and may take up to 8 weeks for delivery.


Liability Waiver:

The following Waiver of Liability is a legal and binding contract, executed in the State of New Jersey. By purchasing any items on this website, I, as buyer, acknowledge and agree that I am at least 18 years of age or am the parent of a child under the age of 18 years. I, as buyer, acknowledge and understand that riding an all-terrain-vehicle (ATV’s, dirt bikes, go karts, motorcycles, mopeds, and gas scooters) is a dangerous activity that requires strenuous exercise and various degrees of skill and experience for individual riders. I, as buyer, understand that these activities can result in serious injury to the person and damages to property and voluntarily assume any and all risk associated with loss, damage or injury while riding the vehicles advertised on our website. I, as buyer, am aware of the risks, hazards and dangers of personal injury, death and disability inherent with the specific use of these vehicles as well as the inherent risks, hazards and dangers of personal injury and disability increase with inexperienced riders. I, as buyer, agree to release and forever discharge Familyfunpowersports LLC and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf and the manufacture from any and all claims, actions, damages, liabilities, cost or expenses and attorney fees which are related to, arise out of, or are in any way connected to your participation or use of these vehicles, use of equipment or property supplied by Familyfunpowersports LLC or your presence upon the premises , whether or not such claims, actions, damages, liability, cost or expenses are caused by the negligence of the seller, Familyfunpowersports LLC manufacture or distributor. By this Agreement, it is my intention as buyer, to surrender and waive any rights to sue or exercise any legal rights to seek damages from or its parent company and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf. This Agreement shall be affecting and binding upon my heirs, agents, personal representatives and assigns. I, as buyer, hereby certify that I am over the age of 18 years of age. I, as buyer, have carefully read the foregoing and acknowledge that I understand and agree to all the above Terms and Conditions. I have had the opportunity to ask any and all questions regarding this Agreement and the affect of the same. I, as buyer, am aware that by purchasing this item and sending/remitting payment for it/them, I assume all risk, and waive and release certain substantial rights that I may have or possess. I, as buyer, therefore release all liability and waive all rights I may have in regards to my child's activities with any items purchased from Familyfunpowersports LLC.


Environmental Compliance:

Familyfunpowersports LLC has currently suspended the distribution of units less than 90cc, and their parts, in order to comply with the new federal lead content restrictions. 

Vehicles on this site have not been tested for lead content as required for products intended for children 12 years and younger. Due to new federal lead content restrictions to reduce potential health risks to children, these vehicles are only recommended for users over 12 years of age.

Legal Status of Products: 

I, as buyer, agree to read the user's manual carefully before operating my vehicle. I, as buyer, agree to inspect my vehicle to be sure all nuts, bolts, fasteners, clips, cotter pins, and chain are tight and the vehicle is safe for operations. I, as buyer, agree to wear a helmet and protective gear when riding. I, as buyer, acknowledge that it is my responsibility, to ascertain and obey all local, state and federal laws in regards to the possession and use of any items purchased from Familyfunpowersports LLC. Familyfunpowersports LLC will not be liable for the misuse of any products purchased from Familyfunpowersports LLC or any of its distributors or agents. I, as buyer, have read this waiver of liability, assumption of risk and indemnity agreement, fully understand its terms, and understand that I, as buyer, am giving up substantial rights by agreeing to this waiver and have brought it freely and voluntarily without any inducement, assurance or guarantee being made to me. My purchase is to be considered as a complete an unconditional release of all liability to the greatest extent allowed by law.
